General Terms and Conditions (GTC)
We thank you for carefully reading these terms and conditions before placing any orders, which signify your agreement to their entirety.
The purchase of the plan allows the client to construct the house only once at the address provided during the purchase.
It is strictly prohibited to resell the plan purchased from ÉVO Plan, whether or not the client has built the house.
If the "Regulations Study" option is not chosen, the client must ensure that the chosen plan complies with the regulations in force in the municipality, as no exchange or refund will be possible once the order is placed.
All of our plans meet the requirements of the National Building Code (NBC) of Canada and comply with the energy standards in force in Canada.
The client will receive:
- A sketch for visualizing the house
- A technical plan with the seal of a member of the Quebec Professional Technologists Order for permit applications, construction, and submission.
This does not include plumbing, electrical, or interior design plans, or the services of an engineer or surveyor. Exterior material choices remain at the discretion of the client.
MODIFICATION OF A PLAN
To make modifications to a plan, please contact-us or choose one of the modification options when making your online purchase.
1. Minor modification
For example: interior layout without touching the stairs, slight movement of an exterior wall, changing windows, etc.
2. Medium modification
For example: moving the stairs, moving several exterior walls, changing roofing, adding rooms, adding masonry, expanding the house, etc.
3. Major modification
For example: moving several exterior walls, changing the architectural style, changing the shape of the house, etc.
Upon receiving the documents, ÉVO Plan will contact the client to ensure a clear understanding of the modifications and to ensure that the client has chosen the appropriate option. If this option does not suit the client, the full payment for the house plan will be refunded to the client, minus a fee of $300 for the project study.
Following the presentation of the modified sketches, the client must inform ÉVO Plan if any adaptations are needed to continue the process. If so, ÉVO Plan will make the necessary changes within a timeframe agreed upon with the client. Once the sketches are approved by the client, ÉVO Plan will begin preparing the final plan. Throughout the process, the client will be informed of billable modification hours. Any new modification requests during the process will be subject to additional fees.
PRICE
The price of plans sold through the website is indicated in Canadian dollars, before taxes, on the product description pages. It is possible that customs fees or other local taxes or import duties may be payable in certain cases, however, these fees are not covered by ÉVO Plan. These rights and sums do not fall under the jurisdiction of ÉVO Plan. They will be the responsibility of the client and are their responsibility (declarations, payment to the competent authorities, etc.). ÉVO Plan reserves the right to modify its prices at any time, while guaranteeing the application of the price indicated at the time of the order.
The plan is not refundable or exchangeable, unless this possibility is mentioned in the selected options. The total billing will be made at the time of purchase on the website, depending on the options chosen.
The total amount may vary depending on modifications made during the execution of the plan, such as:
- modifications requested by the client
- modifications requested by the municipality
- modifications requested by the designer
- other factors.
In exchange for the services rendered, the client must pay ÉVO Plan the price indicated on the website at the time of purchase, as well as any additional modifications and applicable taxes.
If the work is interrupted or suspended for any reason, termination fees may be charged to the client according to the following terms:
- $300 of the estimated total amount if it is mentioned in the selected options;
- 50% of the total billable amount + additional requests made if sketches have been produced (plan with modification);
- 80% of the total billable amount + additional requests made if complete sketches have been produced and modified (plan with modification);
- 100% of the total billable amount + additional requests made if the entire mandate is completed.
DEADLINES & DELIVERY OF PLANS
A confirmation email will be sent to the client upon purchase on the website. The delivery time for files is between 1 and 8 business days for purchases of plans without modifications. The plans will be provided to the client in PDF format with the seal of a member of the Ordre des technologues professionnels du Québec (OTPQ). An additional time may be added for the delivery of plans in case of high activity period or for any other valid reason. If an option is chosen (reverse plan, regulatory study, BCIN certification Ontario, additions or modifications), the time will be re-evaluated according to the request and will be communicated to the client. If this time is not suitable for the client, the full amount of the house plan payment will be refunded, except for an amount of $300 if specified in the chosen options.
Regarding the paper delivery of the plans, they will be printed at a scale of 1/4, in imperial dimensions, with the seal of a member of the Ordre des technologues professionnels du Québec (OTPQ). Delivery will be made by mail to your delivery address according to standard Canada Post delivery times. The cost of delivery is included in the price of the paper copy.
INTELLECTUAL PROPERTY
The client acknowledges and agrees that ÉVO plan holds all rights, titles, and interests in all intellectual property-related materials. The client also agrees not to use the processes, practices, methods, agreements, software, databases, including plans, sketches, images, or drawings of ÉVO plan, as well as any other document produced or prepared by ÉVO plan according to its instructions.
Therefore, the client agrees that they cannot have another plan, image, or house made from documents, sketches, images, or drawings belonging to ÉVO plan.
ÉVO plan disclaims any liability in case a client manages to copy a plan belonging to a third party as a result of a request for modifications to the plan or sketches.
The client acknowledges that they cannot complete or modify sketches, drawings, or plans, either alone or through a third party, without the express written permission of ÉVO plan.
